In this Code, unless the context or subject matter otherwise requires:

A. &ldquoIntentionally&rdquo or &ldquowith the intent to&rdquo means that a persons objective is to cause something to occur or to engage in certain conduct.

 

B. &ldquoKnowingly&rdquo means that a person is aware of a fact or believes that the fact exists. It does not require any knowledge of the unlawfulness of the act or omission. Knowledge of the existence of a particular fact is established if a person is aware of a high probability of its existence, unless he or she actually believes that it does not exist.

 

C. &ldquoRecklessly&rdquo means that a person is aware of and consciously disregards a substantial and unjustifiable risk that a fact exists or that a particular result will occur. The risk must be of such nature and degree that disregard of such risk constitutes a gross deviation from the standard of conduct that a reasonable person would observe in the same situation. A person who creates such a risk but is unaware of it solely because of voluntary intoxication also acts recklessly.

 

D. &ldquoNegligence,&rdquo &ldquocriminal negligence,&rdquo or &ldquonegligently&rdquo means that a person fails to perceive a substantial and unjustifiable risk that a fact exists or that a particular result will occur. The risk must be of such nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that a reasonable person would observe in the same situation.
