(1) If, during the course of an investigation, Elder and Vulnerable Adult Services staff or Tribal Police have been denied access to the Elder or Vulnerable Adult, or to the Elders or Vulnerable Adults residence, they may petition the Tribal Court for a Visitation Warrant.  The purpose of this Visitation Warrant is to investigate a referral of abuse, neglect, exploitation, or abandonment.

(2) The Tribal Court may issue a Visitation Warrant upon a showing of probable cause to believe that an Elder or Vulnerable Adult on those premises has been abused, neglected, exploited, or abandoned, and that Elder and Vulnerable Adult Services staff or Tribal Police has been denied access to the Elder or Vulnerable Adult, or his or her residence.   The Visitation Warrant is enforceable through contempt proceedings provided Chapter 1 of this Code. 

(3) A Visitation Warrant may only be served by Tribal Police.  The Tribal Police officer may allow Elder and Vulnerable Adult Services staff, or any other appropriate person, to accompany him or her in order to interview the Elder or Vulnerable adult and assess his or her living conditions.
