"Elder and Vulnerable Adult Services means those persons employed or appointed by the Kalispel Tribe of Indians who are trained to deliver services in Elder and Vulnerable Adult welfare.  Elder Advocates working for the Tribe shall be included in the definition of "Elder and Vulnerable Services," and duties outlined in this Section may be assigned to them.

(1) Duties.

The duties of Elder and Vulnerable Adult Services shall include, but are not limited to the following:

     (A) Conduct investigations as provided in this Chapter or as directed by the Court.

     (B) Write reports as provided in this Chapter, or as directed by the Tribal Court.

     (C) Make arrangements with outside agencies for investigation services, case management services, or  placement of Elders or Vulnerable Adults. Such arrangements shall not affect the jurisdiction of the Tribal Court over Elders or Vulnerable Adults and families.

     (D) Make recommendations to the Presenting Officer on actions to take in Tribal Court.

     (E) Assist the Elder or Vulnerable Adult in obtaining a state order of protection, if a Tribal Court order will not provide adequate protection.

     (F) Perform additional duties as requested by the Elder and Vulnerable Adult Services Director, Presenting Officer, Tribal Court, or the Tribal Council.

     (G) If appropriate, involve or refer case to Tribal Police or Tribal Prosecutor.  Access to records shall be provided to facilitate police investigation or prosecution.  If appropriate and after consultation with the Tribal Prosecutor, Elder and Vulnerable Services may also refer the case to State or Federal law enforcement, investigators, or prosecutors. 

     (H) If a case involves an Elder, and the Elder Advocate is not assigned to any of the above duties, the Elder shall be given the option to have the Elder Advocate be involved with the case to provide the Elder with advocacy and support.
